\nBubba Blue Australia Pty Ltd of 55 - 57 Lakewood Boulevard, Braeside, VIC 3195, Australia (the Promoter) are holding a 2019 Melbourne Baby Call Out via Instagram and their website www.bubbablue.com.au. Entries open Wedbesdat February 20th 2019 and close Tuesday 6th March 2019 11.59pm. This is a game of skill and chance plays no part. By participating in this promotion, each entrant fully and unconditionally agrees and acknowledges these terms and conditions of entry.

\nBy entering you are giving permission for your images to be shared on the Bubba Blue website and social media platforms. Entry is open to Australian residents only, aged 18 and over.

\nThe winners
\nEach Bubba Blue Baby Call Out winner will:
\n\n\n\t- \n\t
be required to participate in a half day photoshoot in Melbourne

(date and location to be confirmed). The prize does not include travel or accommodation expenses for the child and their parent or legal guardian to the photoshoot, so it is recommended you will be Melbourne based as you will need to make your own way to and from the photoshoot.
\n\t \n\t- \n\t

\n\tat the conclusion of the photoshoot

have the chance for their baby to feature in Bubba Blue advertising campaign imagery. The imagery may feature in in print, packaging, social media, and catalogues as well as other advertising mediums put out by both the promoter and it’s approved retailers. Winning babies may be featured together or separately in the campaign

\nTerms
\n
\n\n\n\t- \n\t
Entrants may only enter a photograph of their own baby, and must be the entered baby’s parents and/or legal guardians. Entrants must own the copyright of any photograph uploaded/entered or otherwise be entitled to use the photograph in this way. The eligible baby in the entry must be appropriately presented and wearing at least a nappy or have equivalent cover.
\n\t \n\t- \n\t
Eligible children from the same family (e.g. eligible children who are twins, triplets, siblings etc) may be entered. Please enter each child as a separate entry
\n\t(however please note in your entry you are entering a sibling/twin/triplet and include a photo of them as a group with each individual entry.
\n\t \n\t- \n\t
The Bubba Blue Baby Call Out winners will be chosen by a judging panel at Bubba Blue Australia. This promotion is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged by Bubba Blue representatives based on the photographs included with the entry, any additional images that have been provided at the Promoter’s request, the entrant’s availability for the photo shoot, and the potential suitability of the entered Baby to represent Bubba Blue in it’s advertising and promotional campaigns.
\n\t \n\t- \n\t
A shortlist of entrants will be selected by Bubba Blue on Wednesday 7th March 2019. Shortlisted entrants may be asked to supply additional images of the entered baby, confirm the baby’s age, size, their availability for the photoshoot, and give permission to the Promoter to use their entry content for the promotion of the competition and in relation to the announcement and publicity of winners.
\n\t \n\t- \n\t
From the shortlist, the Promoter will then choose the winners who will participate in the Baby Call Out Photo Shoot.
\n\t \n\t- \n\t
The Bubba Blue Baby Call Out winners (those chosen by the Promoter) will be announced on 11 March 2019 on www.bubbablue.com.au. All winners will be notified individually either via instagram direct message, or email depending on the entrant’s method of entry.
\n\t \n\t- \n\t
Once winners have been announced/contacted, if a response is not received in 48 hours, another entrant will be chosen.
\n\t \n\t- \n\t
If for any reason, a winner and/or their entered baby is not able to travel and/or participate in the Promoter’s Baby Call Out photo shoot on the date scheduled by Bubba Blue, the Promoter may at its discretion:
\n\ta. disqualify the winner and their entered baby (who will then forfeit all related elements of their prize); and/or
\n\tb. use only the entered babies of other winners in its baby Call Out campaign shoot, and/or
\n\tc. select one of the other short-listed entrants as an additional winner.
\n\t \n\t- \n\t
Entrants warrant and agree that, without limitation:
\n\ta. they will not submit any material (including without limitation, the entry itself, images, answers to questions, posts or comments on the Bubba Blue website or elsewhere in relation to this competition or any entrant or entry) (Content) that is unlawful or fraudulent or that may be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication in the context of this competition;
\n\tb. they will only submit images which they have personally created or have the right to submit;
\n\tc. their entry will not contain viruses or cause injury or harm to any person or entity;
\n\td. they are the parents and/or legal guardians of the baby/babies in the entry;
\n\te. they will comply with these Conditions of Entry and with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems;
\n\tf. they have the full authority to grant to the Promoter the rights referred to in these Conditions of Entry; and
\n\tg. they will indemnify the Promoter against all costs and claims by third parties arising from a breach these Conditions of Entry.
\n\t \n\t- \n\t
Bubba Blue reserves the right, at any time, to verify the validity of entries and entrants. Without limitation, entrants agree to provide a copy of the entered baby’s birth certificate to the Promoter upon request. The Promoter has the right to invalidate any entry which it considers to be (or may be) in breach of these Conditions of Entry. Promoter’s decision in relation to all aspects of the promotion is final and no correspondence will be entered into.
\n\t \n\t- \n\t
If requested by the Promoter, winners will sign a legal disclaimer on reasonable terms determined by the Promoter as a condition of taking any prize.
\n\t \n\t- \n\t
Entrants consent, in the event they are a winner, to Bubba Blue using any photographs or video footage taken at the Bubba Blue campaign shoot for an unlimited period for the purposes of any advertising and promotion of the Promoter and its products. Such advertising and promotion may include, without limitation, use of photographs on product packaging, point of sale materials, catalogues, magazine and newspaper advertising, outdoor advertising, posters and internet advertising which will be used by the promoter and it’s approved retailers. All photographs, videos and any related rights, including without limitation any intellectual property rights, become the property of the Promoter.
\n\t \n\t- \n\t
If for any reason this Promotion is not capable of running as planned, including but not limited to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserve the right in its sole discretion, subject to any written directions given by any relevant authority in each State and Territory, to cancel, terminate, modify or suspend the Promotion.
\n\t \n\t- \n\t
The Promoter may, in its sole discretion, disqualify any entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise.

The Promoter and associated agencies and companies (and their officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
