Silver Membership
\n\nMinimum of 6 fortnightly direct debit payments of $120.00 ($123.19 if paying by credit card).
\n\t2 Group Reformer (1:5) classes per week.
\n\t12 week minimum commitment. Memberships will continue beyond the 12 week initial commitment unless Integrated Body Arts is notified of a cancellation request in writing.
\n\tShould you wish to terminate your membership before it comes to an end, you will be asked to pay the remaining time on your contract.
\n\tIf you do not wish to continue after the 12 week commitment, you must provide Integrated Body Arts with at least 2 weeks written notice prior to next direct debit date to cancel your membership.
\n\tAfter the 12 week commitment, you can suspend your membership for a period of no less than 2 weeks and to a maximum of 8 weeks in any 12 month period.
\n\tBookings are essential and booking early is recommended to avoid disappointment.
\n\tGroup classes have an 8 hour cancellation policy. You must cancel your class booking online at least 8 hours before the start of your class to avoid forfeiting your class credit.
\n\tIf paying by credit card, membership fee will include credit card surcharge of $3.19 per transaction.

Integrated Body Arts Membership Agreement Terms and Conditions
\n\n
\n\nThe agreement is between member, and Integrated Body Arts (Daily Pilates Pty Ltd) ABN 11 159 147 832 located at 82 Glen Eira Rd, Ripponlea VIC 3185. The agreement becomes legally binding from the date of agreement (date member signs up for membership).
\n\n
\n\nI, the member agree to the terms and conditions of this Silver Membership agreement as stated below.
\n\n
\n\nI understand that failure to comply with the terms and conditions of this agreement may result in the suspension or cancellation of my membership, or in financial penalties as laid out below.
\n\n
\n\n1. Integrated Body Arts Obligations
\n1.1 Subject to clause 9.1(d), Integrated Body Arts must provide the Services to the Member to a professional standard.
\n1.2 Integrated Body Arts may change:
\n(a) any aspect of classes; and
\n(b) hours of operation,
\nfrom time to time in its discretion.
\n\n2. Member Entitlements
\n2.1 Silver Membership entitles the Member to 2 Group Reformer (1:5) classes per week.
\n\n3. Member’s Obligations
\n3.1 The Member must promptly comply with the Agreement.
\n3.2 The Member must ensure that the Fees are available in cleared funds in the Nominated Account every 14 days from the First Direct Debit Date.
\n3.3 The Member authorises Integrated Body Arts or Integrated Body Arts’ agent (including Ezidebit) to deduct Fees by direct debit every 14 days from the First Direct Debit Date until the termination of the Agreement in accordance with the Agreement.
\n3.4 If the Member breaches clause 3.2, the Member will automatically be charged a declined fee of $14.80 to the Nominated Account within 7 days of notice.
\n3.5 Cancellation policy – Members must comply with Integrated Body Arts booking cancellation policy.
\n3.6 3 strikes policy – three late cancels/no shows within 28 days will result in suspension of the Member’s ability to book classes online for a week.
\n\n4. Changes to Fees
\n4.1 Integrated Body Arts may amend the fee for any Service at any time in its discretion with no less than 35 days prior notice to the Member.
\n4.2 If Integrated Body Arts increases a fee under clause 4.1, the Member is deemed to have authorised the deduction of the increased fees under clause 3.3.
\n\n5. Changes to Services
\n5.1 Integrated Body Arts may amend the Services at any time in its discretion with no less than 35 days prior notice to the Member.
\n\n6. Termination by Member
\n6.1 The Member acknowledges that there is an initial 12 week minimum commitment. Membership will continue beyond the 12 week initial commitment unless Integrated Body Arts is notified of a cancellation request in writing.
\n6.2 Should the Member wish to terminate the Membership before the initial 12 week minimum commitment comes to an end, the Member would be required to pay the remaining time on the Contract.
\n6.3 The Member may terminate the Agreement immediately with 2 weeks prior written notice to Integrated Body Arts.
\n\n7. Termination by Integrated Body Arts
\n7.1 Integrated Body Arts may terminate the Agreement immediately with 28 days prior written notice to the Member.
\n\n8. Mutual Termination
\n8.1 Either party may immediately terminate the Agreement if the other party does not rectify a breach of the Agreement within 14 days after receipt of written notice reasonably specifying such breach.
\n8.2 Notwithstanding anything stated in these terms and without prejudice to any of its other rights, if Integrated Body Arts terminates the Agreement under clause 8.1, the Member must pay to Integrated Body Arts within seven days all outstanding Fees (if any).
\n\n9. Suspension by Integrated Body Arts
\n9.1 Integrated Body Arts is not obliged to provide any Service:
\n(a) during the Christmas holiday period;
\n(b) during public holidays;
\n(c) during any period of force majeure; and
\n(d) while a Member remains in breach of the Agreement.
\n\n
10. Suspension by Member
\n10.1 A Member may suspend the operation of the Agreement at no cost:
\n(a) if the Member is pregnant, seriously injured or seriously ill, for the period of such circumstance; and
\n(b) in any other case, for not less than two weeks and no more than eight weeks per year in weekly increments,
\nby giving notice to Integrated Body Arts in the form of a suspension notice as directed by Integrated Body Arts.
\n\n
11. Pro Rata Payments on Termination or Suspension
\n11.1 If a party terminates or suspends the agreement under clauses 6.1, 7.1, 8.1, 9.1 or 10.1, the member remains obliged to pay the Fees:
\n(a) during any notice period and until it takes effect; and
\n(b) on a pro rata basis calculated daily.
\n\n
12. Medical Certificate
\n12.1 Integrated Body Arts may at any time in its discretion:
\n(a) request the Member supply a medical certificate; and
\n(b) suspend providing the Services to the Member until such medical certificate is provided.
\n12.2 The Member must comply with a request under clause 12.1 within seven days.
\n\n
13. Waiver
\n13.1 The Member:
\n(a) voluntarily accepts and assumes all risks flowing from participating in the Services; and
\n(b) agrees not to make any claim against Integrated Body Arts for compensation or damages of any kind (whether direct, indirect, consequential, economic, special or otherwise) that may be suffered or incurred by the Member arising in connection with this Agreement or the Services other than as a result of negligence by Integrated Body Arts.
\n\n
14. Miscellaneous
\n14.1 Integrated Body Arts may procure subcontractors to perform any of Integrated Body Arts' obligations under the Agreement.
\n14.2 Integrated Body Arts may transfer the Agreement.
\n14.3 The Member may not transfer the Agreement in whole or in part.
\n14.4 Any notice to or by a party to these terms:
\n(a) may be given by post or email to the other party’s address as directed from time to time; and
\n(b) must be in writing, legible and in English,
\nand such notice is deemed to have been given on the date it is received by the other party.
Please note, all online payments will appear on your bank statement as EZIDEBIT. Should Integrated Body Arts incur costs associated with a dispute of this transaction via your bank, you will be responsible for these costs.
\n\n\n\n
15. Definitions
\n15.1 In these terms and conditions:
\nAgreement includes:
\n(a) these terms and conditions; and
\n(b) the Particulars; and
\n(c) the Code of Conduct.
\nCode of Conduct means Integrated Body Arts’ written code of conduct in place from time to time (if any).
\nDecline Fee means the Direct Debit Decline Fee specified in the Particulars and will increase in accordance with Ezidebit’s increase in fees.
\nFee/s means singularly and collectively:
\n(a) the fees specified in the Particulars as amended from time to time under clause 4.1; and
\n(b) any other amounts payable by the Member under the Agreement including in accordance with clause 11.
\nFirst Direct Debit Date means the first direct debit date specified in the Particulars.
\nMember means the member specified in the Particulars.
\nNominated Account means the account nominated in the Particulars.
\nParticulars means the relevant document entitled Integrated Body Arts Membership Agreement signed by Integrated Body Arts and the Member.
\nService/s means singularly and collectively:
\n(a) the services specified in “Services” in the Particulars as amended from time to time under clause 5.1; and
\n(b) and any other services offered by Integrated Body Arts to the Member from time to time.
