This Privacy Policy is intended to describe why and how BeMyEye Holdings Ltd, and its subsidiaries (collectively "BeMyEye"), as Data Controller ("BME", "Company" or "Data Controller"), collects and processes the personal data relating to the user ("User") who interacts with the website https://www.bemyeye.com ("Website") and with the various services offered through the website.

The information contained in this Privacy Policy is provided pursuant to art. 13 of the EU Regulation of 27 April 2016 n. 679 ("Regulations"), under the applicable provisions of the law, for the protection of personal data as per the Guidelines set out by the European authorities.
\n\nThe information related to the processing of data concerns only the user activity on the Website, and does not extend to the processing operations performed by third parties of other sites the User may visit via links. With respect to these further processing operations, the Company assumes no responsibility, and the User must refer to the individual Privacy Policy of third party websites.

\n\nThe data is mainly processed at the premises of the Data Controller, by technical staff of the appointed company in charge of processing, within the territory of the European Union, but data related to the services offered by third parties may be processed outside the the European Union. In the case of transfer of data to countries that do not uphold a standard of protection equivalent to that of European Union, the Company undertakes to adopt the necessary measures for this transfer.

The Company processes User data by adopting all appropriate security measures to prevent unauthorized access and the disclosure, modification or destruction of unauthorized data. The processing is carried out with both manual and computerized tools and is strictly limited to the purposes indicated.

4. Purposes of data processing and legal basis of processing

The Company, through the Website, may process User data for the following purposes:

a. For the receipt of job applications via the "Careers" section. The Company offers the User the opportunity to send an e-mail application via the "Careers" section of the website. To this end, the Company will acquire and use the information provided by the User exclusively for the purposes of selection and management of applications. In every case, the User is encouraged not to include sensitive data in his or her CV (for example that which concerns health status, political opinions, sex life, etc.), and is encouraged only to include data that is strictly necessary according to the law for the purposes of selection and evaluation of the CV. Furthermore, the Company may request that the User consent to the sharing of his or her CV with other companies in the BME Group, and to be contacted by other companies in the BME Group (as autonomous data controllers) in relation to selection and recruitment.

b. Contact the Company. The Company offers the User the ability to communicate with the Company, and to send requests for information on the Company’s activities, initiatives and services. In this regard, the personal data provided by the User (e.g. email address, telephone number and / or other information provided by the User) will be processed by the Company, in order for the company to grant the User's request. The granting of the User’s request exhibits the legal basis of the processing, since the company cannot grant the User’s request without the User’s voluntary provision of personal data.
\n\nc. Access to free reports. The Company offers the User the ability to download its research reports, after filling in the relevant form. Again, the granting of the User’s request exhibits the legal basis of the processing, since the company cannot grant the User’s request without the User’s voluntary provision of personal data.

d. Marketing objectives of BME. The Company sends out information about its products and services, and is interested in offering the User the opportunity to participate in events and workshops organized by the Company or by its commercial partners. By providing their data to download reports, the user is recorded in the Company database as a subject interested in Company services / products. Information sent to the User by the Company will be in line with the User’s requests and with the products they use. The User can unsubscribe by clicking on “unsubscribe” at the bottom of the emails sent by the Company. The legal basis of the processing is exhibited by the Company deeming the User to have shown genuine interest in the Company’s services. The User can at any time withdraw their consent by contacting the Company at the addresses indicated in the section "Rights of the User and Contacts", as well as via the relevant link in the emails received.

e. Pursuit of the legitimate interests of the Company and / or third parties. The User's data may also be used for the exercise of the rights and legitimate interests of the Company and / or third parties, for example the right to defence in court, the management of complaints and litigation, the possible recovery of claims, and prevention of fraud and / or illegal activities. In these cases, data that is relevant to the pursuit of such legitimate interests may be used. Any refusal from the User to provide their personal data would prevent the Company from granting the User’s request for information.

f. Comply with legal obligations and / or applicable regulations. The Company may also use the personal data provided by the User or otherwise acquired during the User's interaction with the Website for purposes related to compliance with legal obligations and national and European Community regulations. g. Use of the services by the Company's customers: the Company's customer has the ability to use the services offered through the Company’s Website. BME's client companies can assign profiles of differing levels of authorization to their employees or company contacts. The Company provides access to these users, and monitors and controls their access, not only for security purposes but also to enable analysis and improvement of the service. The data and information collected through use of the service will be also used by the Company for the purpose of evolutionary maintenance of the platform.

h. Perform aggregated statistical analysis on an anonymous basis in order to improve the services offered by the Company through the Website. In this case, consent from the User will not be necessary, as the processing will be carried out on anonymous data only.

\n\n• companies, collaborators, consultants or freelancers used by the company to perform technical or organizational tasks (such as IT service providers), or with which the Company collaborates (including other BME companies), for the purpose of providing its services or carrying out communication activities;
\n\n• persons, companies or professional firms that provide assistance and advice to the Company, with particular but not exclusive reference to accounting, administrative, legal, tax and financial matters;
\n\n• subjects whose right to access data is recognized by legal provisions or by authorities' orders.
\n\nThe subjects belonging to the above categories will use the data as independent data controllers in accordance with the law or data processors duly appointed by the Company.
\n\nThese subjects may be established in EU and non-EU countries. In particular, if said subjects are established in non-EU countries, the Company adopts the measures outlined by the Regulations to legitimize the transfer of personal data to them, and specifically in the United States by virtue of the accession of suppliers to the program Privacy Shield.
\n\nThe list of subjects to whom the data are or may be communicated, as well as the privacy measures adopted to legitimize non-EU transfers, can be requested from the Company by contacting the addresses given in the "User Rights and Contacts" section.

7. Data retention

The data is processed only for the time necessary to carry out the activities indicated in paragraph 3 above.
\n\nIn particular, the Company will delete the personal data of the User who has requested it be deleted by writing to privacy.users@bemyeye.com. In the absence of such a request, the Company will:
\n\n- delete the personal data of a User that has applied for positions of employment in the Company 12 months after the application date if the User does not establish a working relationship with the Company;
\n\n- delete the data collected for marketing purposes 24 months after the request to unsubscribe;
\n\n- delete the data of Users who connect to the Website to use purchased services after 24 months of inactivity.

8. Rights of the User and contacts

The User may exercise where applicable, in the cases expressly set out by law, the rights outlined by the Regulations. In particular, the User has the right to:
\n\n• request confirmation that the Data is being processed and, in this case, ask the Data Controller to access the information related to the processing;
\n\n• request the correction of inaccurate or incomplete Data;
\n\n• ask the Data Controller to delete the Data;
\n\n• request the limitation of processing;
\n\n• request to receive, in readable format, the data concerning him/her or to directly transmit the data to another holder, where technically feasible ("data portability").

9. Collection of data through Cookies

BME's client companies can assign profiles of differing levels of authorization to their employees or company contacts. The Company provides access to these users, and monitors and controls their access, not only for security purposes but also to enable analysis and improvement of the service. The data and information collected through use of the service will be also used by the Company for the purpose of evolutionary maintenance of the platform.

h. Perform aggregated statistical analysis on an anonymous basis in order to improve the services offered by the Company through the Website. In this case, consent from the User will not be necessary, as the processing will be carried out on anonymous data only.

5. Categories of data processed

7. Data retention

4. Propósitos del procesamiento de datos y base legal de procesamiento

En este sentido, la Compañía procesará los datos personales proporcionados por el Usuario (por ejemplo, dirección de correo electrónico, número de teléfono u otra información proporcionada espontáneamente por el Usuario) para hacerse cargo, gestionar correctamente y responder a la comunicación del Usuario. La Compañía implementa actividades de información sobre sus productos y servicios, y está interesada en ofrecerle la oportunidad de participar en eventos, talleres organizados por la Compañía o sus propios socios comerciales. 7. Retención de datos

7. Rétention de données

Les données sont traitées pendant le temps nécessaire pour mener à bien les activités indiquées au paragraphe 3 ci-dessus et sont annulées dès que les finalités pour lesquelles elles ont été collectées et traitées cessent d'exister.

\n\n- supprimer les données collectées à des fins de marketing après 24 mois à compter de la demande de «désabonnement» présente dans les emails de la société;
\n\n- supprimer les données des Utilisateurs qui se connectent au Site pour utiliser les services achetés après expiration de 24 mois d'inactivité.

8. Droits de l'utilisateur et des contacts

In caso di trasferimento dei dati in Paesi che non presentino standard di tutela pari a quella italiana, la Società si impegna ad adottare le misure necessarie a tale trasferimento.

3. Modalità del trattamento dei dati

La Società tratta i dati dell’Utente adottando tutte le opportune misure di sicurezza volte ad impedire accessi non autorizzati, nonché la divulgazione, modifica o distruzione dei dati non autorizzate. Il trattamento viene effettuato con strumenti sia manuali che informatici e/o telematici, con modalità organizzative e con logiche strettamente correlate e limitate alle finalità indicate.

4. Finalità del trattamento dei dati e base giuridica del trattamento

La Società, attraverso il Sito, potrà trattare i dati dell’Utente per le seguenti finalità:

a. Finalità di raccolta delle candidature tramite la sezione “Careers”. La Società offre all’Utente l’opportunità di inviare via email la propria candidatura per lavorare in BME attraverso la sezione del Sito “Careers”. A questo fine, la Società acquisirà e utilizzerà le informazioni fornite dall’Utente attraverso l’invio spontaneo del CV per esclusive finalità di selezione e gestione delle candidature. Ad ogni modo, si invita l’Utente a non inserire nel proprio CV dati di natura sensibile (es. relativi allo stato di salute, opinioni politiche, vita sessuale, etc.), se non quelli strettamente necessari ai sensi di legge per le finalità di selezione e valutazione del CV (es. appartenenza a categorie protette). La Società, inoltre, potrà richiedere all’Utente di esprimere volontario consenso ai fini della comunicazione del proprio CV alle altre società del Gruppo BME, per essere contattato da queste ultime (in qualità di autonomi titolari del trattamento) per le rispettive attività di selezione e recruitment.

b. Contatto la Società. La Società offre all’Utente la possibilità di inviare comunicazioni alla Società, domande e richieste di informazioni sulle attività, iniziative, servizi della stessa. A questo proposito, i dati personali forniti dall’Utente (es. indirizzo email, numero di telefono e/o altre informazioni spontaneamente fornite all’Utente) saranno trattati dalla Società per prendere in carico, gestire correttamente e rispondere alla comunicazione dell’Utente. La base giuridica del trattamento è rappresentata dall’esecuzione del servizio espressamente richiesto dall’Utente, e l’eventuale rifiuto di fornire i dati personali comporta l'impossibilità per la Società di gestire e riscontrare la comunicazione o la richiesta di informazioni.

c. Accesso ai Report gratuiti. La Società offre all’Utente la possibilità di scaricare, previa compilazione dell’apposito form, i propri rapporti di ricerca (o Report). La base giuridica del trattamento è rappresentata dall’esecuzione del servizio espressamente richiesto dall’Utente, e l’eventuale rifiuto di fornire i dati personali comporta l'impossibilità per la Società di consentire il download del Report richiesto dall’Utente.

d. Finalità di marketing di BME. La Società realizza attività informative circa i propri prodotti e servizi, ed è interessata ad offrirti la possibilità di partecipare ad eventi, workshop organizzati dalla Società o da propri partner commerciali. Inserendo la Tua email ed i tuoi dati per scaricare i nostri report sei stato inserito nelle nostra banche dati come soggetto interessato ai nostri servizi/prodotti. Le comunicazioni informative che ti manderemo saranno in linea con quanto da te richiesto ed con i servizi/prodotti usufruiti. Potrai sempre disinscriverti al servizio tramite l’unsubscribe che trovi in calce alle nostre email. La base giuridica del trattamento è costituito dall’interesse legittimo che la Società ha valutato sussistente ed idonea a non inficiare i suoi diritti e la tutela dei suoi dati. In qualsiasi momento l’Utente potrà opporsi agli invii e revocare il proprio consenso rivolgendosi alla Società ai recapiti indicati nella sezione “Diritti dell’Utente e Contatti”, nonché tramite l’apposito link presente nelle email ricevute.

e. Perseguimento dei legittimi interessi della Società e/o di terzi. I dati dell’Utente potranno altresì essere utilizzati per l’esercizio dei diritti e dei legittimi interessi della Società e/o di terzi, ad esempio il diritto di difesa in giudizio, la gestione dei reclami e del contenzioso, l’eventuale recupero dei crediti, la prevenzione di frodi e/o di attività illecite. In questi casi, seppure il conferimento dei dati personali dell’Utente non sia obbligatorio, esso risulta comunque necessario in quanto tali dati sono strettamente connessi e strumentali al perseguimento di tali interessi legittimi, che non prevalgono sui diritti e sulle libertà fondamentali dell’Utente, e l'eventuale rifiuto di fornirli potrebbe comportare l'impossibilità di erogare i servizi richiesti (es. richiedere informazioni alla Società).

f. Adempiere ad obblighi di legge e/o obblighi applicabili. La Società potrà altresì utilizzare i dati personali forniti dall’Utente o altrimenti acquisiti nel corso dell’interazione dell’Utente con il Sito per finalità connesse all’esecuzione di obblighi di legge, regolamenti, normative nazionali e comunitarie nonché derivanti da disposizioni impartite da autorità a ciò legittimate dalla legge, che rappresentano la base giuridica del trattamento, senza necessità di ottenere il preventivo consenso dell’Utente.

g. Utilizzo dei servizi da parte dei clienti della Società: il cliente della Società ha la possibilità di usufruire, tramite il Sito, dei servizi acquistati, attraverso la creazione di un proprio profilo. Le aziende clienti di BME hanno infatti la possibilità di assegnare diversi profili autorizzati ai propri dipendenti o referenti aziendali. La Società consente l’accesso a detti utenti e provvede al monitoraggio e controllo degli accessi e dell’utilizzo del servizio non solo per finalità di sicurezza ma altresì per attività di analisi e miglioramento del servizio. \n\n• persone, società o studi professionali che prestino attività di assistenza e consulenza alla Società, con particolare ma non esclusivo riferimento alle questioni in materia contabile, amministrativa, legale, tributaria e finanziaria;
\n\n• soggetti cui la facoltà di accedere ai dati sia riconosciuta da disposizioni di legge o da ordini delle autorità.
\n\nI soggetti appartenenti alle categorie sopra indicate utilizzeranno i dati in qualità di autonomi titolari del trattamento ai sensi di legge o di responsabili del trattamento di dati regolarmente nominati dalla Società.
\n\nTali soggetti potranno essere stabiliti in Paesi UE e extra-UE. In particolare, in caso in cui detti soggetti siano stabiliti in Paesi extra-UE, la Società adotta le misure previste dal Regolamento per legittimare il trasferimento dei dati personali ai medesimi, e specificamente negli stati Uniti in forza dell’adesione dei fornitori al programma di Privacy Shield.

7. Conservazione dei dati

I dati sono trattati per il tempo necessario allo svolgimento delle attività indicate al precedente paragrafo 3, e sono cancellati al venir meno degli scopi per i quali sono stati raccolti e trattati.
\n\nIn particolare, la Società provvederà ad eliminare i dati personali dell’Utente che ne faccia richiesta scrivendo all’indirizzo privacy.users@bemyeye.com In mancanza di tale richiesta la Società provvederà:
\n\n- ad eliminare i dati personali dell’Utente che ha inviato la propria candidatura a posizioni di lavoro della Società dopo 12 mesi dal conferimento degli stessi, nel caso in cui il candidato non instauri un rapporto di lavoro/collaborazione con la Società;
\n\n- ad eliminare i dati raccolti per le finalità di marketing decorsi 24 mesi dalla richiesta di “unsubscribe” presente nelle email della società;
\n\n- ad eliminare i dati degli Utenti che si collegano al Sito per usufruire dei servizi acquistati una volta che siano decorsi 24 mesi di inattività.

8. Diritti dell’Utente e contatti

L’Utente può esercitare, nei casi espressamente previsti dalla legge e ove applicabili, i diritti previsti dal Regolamento. In particolare, l’Utente ha il diritto di:
