National Phase Deadline
\n\n
\n\nThe deadline for national phase entry into New Zealand is 31 months from the earliest priority date.
\n
Please let us know if you have missed the deadline. In some cases an extension of time is available.
\n\n
\nMinimum Documentation
\n\nWe only need the international application or publication number to go ahead with national phase entry in New Zealand, if the international application was published in English.
\n
You do not need to provide a power of attorney or any other documents executed by the Applicant or the Inventor.
\n
However, we will need confirmation of the manner in which the applicant is entitled to the patent in New Zealand together with copies of any documents establishing that entitlement.
\n\n
\n\nInternational Application not in English
\n\n
\n\nFor international applications in a language other than English or Maori, an English translation, verified by the translator, must be filed within three months of national phase entry into New Zealand. This extendable by two months.
\n
The patent examiner may request a verified English language translation of the priority patent document if a validity-related issue arises, in which determination of the correct priority date is important.
\n\n
\nNovelty Requirements
\n\nNew Zealand is a first-to-file, absolute novelty country. Publication of the invention or public use anywhere in the world before the priority date can invalidate any patent granted on an application.
\n\n
\n\nGrace Period
\n\n
\n\nNew Zealand has a 12-month "grace period" for any disclosures that took place on or after 30 December 2018.
\n
The Applicant may provide a statement that the invention had been publicly disclosed by or with the consent of the Applicant in the 12-month period prior to the filing date of the complete specification.
\n
The statement may be provided to IPONZ before the start of examination, or in response to an objection that the claimed invention is not novel or inventive in light of the disclosure.
\n\n\n\n
Prosecution
\n\n
\n\nA request for examination must be filed within 5 years of the filing date of the international application. However, the Commissioner will usually direct the Applicant to request examination of the patent application within about 6 to 9 months from national phase entry.
\n\nThe direction sets a 2-month period within which examination must be requested.
\n\n
\n\nAn adverse examination report sets a 6-month deadline for filing a response. Subsequent examination reports set a 3-month deadline for filing a response.
\n\n
\n\nThe patent application must be placed in order for acceptance within 12 months from issuance of the first examination report.
\n\n
\n\nIt is possible to expedite examination of the New Zealand patent application using the Global Patent Prosecution Highway (GPPH). More information on this is available here.

Term and Renewal
\n\n
\nRenewal fees are payable on the 4th anniversary of the international application filing date, irrespective of whether or not a patent has been granted.
\n\nThe term of a New Zealand patent is 20 years from the filing date.
