The system is based on the principle that a government will provide an inventor with a monopoly in an invention for the life of the patent. In return, the patentee must provide instructions to the public on how to put the invention into practice.
\n
\nThus, the patent system is based on a quid pro quo. As such, the patent system sets up what is effectively a social contract between the inventor and the state. That contract is an agreement that the government will grant the patentee a monopoly for the life of the patent. In return, the public will have full access to sufficient information freely to exploit the invention once the patent expires.
\n
\nThe vehicle for facilitating the quid pro quo is the patent specification. The specification must therefore perform two functions. It must define the protection sought by the inventor and it must describe to a person of ordinary skill in the field of the invention how to practice the invention.
\n\nPatent legislation around the world sets out a number of important requirements:

\n\nThe invention must be proper "subject matter"
\n\tThe invention must be novel.
\n\tThe invention must be inventive or non-obvious.
\n\tOnly the inventor(s) is entitled to the grant of a patent, unless there is an agreement to the contrary.
\n\t
\n\nSo keep the invention secret until you have contacted us! There is no way to test the market commercially and then to file a patent application without falling foul of our novelty requirements. Australia and the United States (amongst a few others) do offer a "grace period" within which to file a patent application after public disclosure. However, we strongly recommend against relying on the grace period. At the very least, contact us for a meeting while the invention is confidential.

\n\nIt is also important that you understand that a patent can only be granted to an inventor or co-inventors. It follows that for a company or some other legal entity to own the invention, the invention will have to be assigned to that company or legal entity. Ownership is a critical aspect of patent practice and getting it wrong could result in the loss of rights.
